Terms of Service

Welcome to PetScope. These Terms of Service (“Terms”) govern your use of the PetScope mobile app and website (together, the “Service”). By creating an account or using PetScope, you agree to these Terms. If you don't agree, please don't use the Service.

1. Who can use PetScope

You must be at least 13 years old (or the age of digital consent in your country, if higher) to use PetScope. If you are using the Service on behalf of a household, you confirm you have the authority to do so.

2. Your account

PetScope uses passwordless sign-in. You're responsible for keeping access to the email address linked to your account, since anyone with access to that inbox can sign in. Tell us immediately at [email protected] if you suspect unauthorized use of your account.

3. What PetScope does and what it isn't

PetScope helps you understand pet food labels by analyzing ingredient lists with the help of AI. The output is informational and educational. PetScope is not a substitute for professional veterinary advice, diagnosis, or treatment. Always consult a qualified veterinarian about your pet's diet, allergies, or medical conditions. Don't rely on PetScope alone to make decisions that affect your pet's health.

Ingredient analysis is generated by AI models and external data sources. It can be incomplete, out of date, or wrong. We make no guarantee of accuracy, completeness, or fitness for any particular pet.

4. Subscriptions and payments

PetScope offers a free tier with limited usage and a Premium subscription that unlocks higher limits and additional features. Premium is currently $2.99/month, sold and billed by Apple through your Apple ID.

Renewal: Premium auto-renews each billing period until you cancel. Cancellation must be done through your Apple ID subscription settings at least 24 hours before the next renewal.
Refunds: All payments are processed by Apple under Apple's terms. Refund requests must be made through Apple.
Pricing changes: If we change the price, we'll notify you in advance. Continued use of Premium after a price change means you accept the new price.
Free tier: We may adjust the limits of the free tier at any time.

5. Acceptable use

You agree not to:

Use the Service for anything illegal, harmful, or that infringes someone else's rights.
Reverse engineer, decompile, or attempt to extract our source code (except as expressly permitted by law).
Scrape, copy, or republish PetScope's content or output at scale.
Use bots, scripts, or automated tools to bypass usage limits, quotas, or rate limits.
Submit content that is unlawful, hateful, harassing, or that contains malware.
Interfere with the Service, our infrastructure, or other users' use of the Service.

6. Your content

You retain ownership of the pet profiles, ingredient text, and photos you submit (“Your Content”). You grant us a limited, worldwide, royalty-free license to host, process, transmit, and display Your Content solely to operate and improve the Service for you. We do not sell Your Content.

You're responsible for Your Content. Don't upload anything you don't have the right to share.

7. Our content and trademarks

The PetScope name, logo, app, website, and all related materials are owned by us and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable license to use the Service for your own non-commercial use, subject to these Terms.

8. Third-party services

The Service relies on third-party providers. Their services are governed by their own terms, and we're not responsible for them. See the Privacy Policy for details on how your data data is shared.

9. Termination

You can stop using PetScope at any time and request account deletion by emailing us. We may suspend or terminate your access if you violate these Terms or use the Service in a way that creates risk for us or other users. On termination, your right to use the Service ends; provisions that by their nature should survive (such as ownership, disclaimers, and limitations of liability) will continue to apply.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated analysis will be correct.

11. Limitation of liability

To the maximum extent permitted by law, PetScope and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim related to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) US$50.

Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

12. Indemnification

You agree to defend and indemnify PetScope from any claim, loss, or expense arising from your misuse of the Service, your violation of these Terms, or your violation of any third party's rights.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute that can't be resolved informally will be brought exclusively in the state or federal courts located in California, and you consent to that jurisdiction. Nothing in these Terms prevents either of us from seeking injunctive relief in any competent court.

14. Changes to the Service or these Terms

We may add, change, or remove features at any time. If we make material changes to these Terms we'll update the “Last updated” date above and, where appropriate, give you notice in the app or by email. Your continued use after a change means you accept the updated Terms.

15. Apple-specific terms

If you use PetScope on iOS, you acknowledge: these Terms are between you and PetScope, not Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support. To the extent permitted by law, Apple is not responsible for any product warranties or product liability claims relating to the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
